SHORT RENTALS
The rental of all properties on the website www.marcheholiday.it and contained in the catalog has the legal nature of "Tourist Rental" and is concluded by MARCHE HOLIDAY VILLAS S.R.L. on behalf of the respective owners with their express authorization, according to the prices advertised on the website in compliance with the terms and conditions set out in the private agreement stipulated with the owners themselves. On the site you will find the subdivision of the properties into two types: PRIVATE STRUCTURES and ACCOMMODATION STRUCTURES, in both cases located in Self Catering (fully equipped houses, supplied with linen but not equipped with household cleaning and personal hygiene products). According to Italian and regional laws, the name Private Structure derives from the fact that the owner rents the property as a private individual and not as a company or accommodation facility with particular hotel or similar licenses, and cannot, therefore, provide additional hotel-type services (change of linen, midweek cleaning, etc.) during the guest's stay, which are instead possible in so-called Accommodation Structures. These services can only be provided by third parties and paid directly by the guest on site. Furthermore, private structures, in the absence of guests, are very often inhabited by the owner, therefore the rental is considered occasional and not continuous and above all in a non-entrepreneurial form. Since these are private homes for holiday use, they do not have internationally recognized standards or categories, but rather reflect local traditions and the personal taste of the owner in their architecture and furnishings, so it is normal - as is normal in the houses where we usually live - that there may be small defects.
LEASE PERIOD
MARCHE HOLIDAY VILLAS S.R.L. deals with weekly rentals that extend from Saturday to Saturday, for a maximum of 4 consecutive weeks in favor of the same customer, if otherwise provided for in the agreement with the owner. It will be possible to make short stays, or with arrivals and departures on days other than Saturday, only in some facilities. Structures classified as "private" are generally rentable only during certain periods of the year.
BOOKING PROCEDURE WITH BANK TRANSFER
Having received the booking request by bank transfer (via website/email/telephone) and verified the availability of the property for the selected period, MARCHE HOLIDAY VILLAS S.R.L. will reserve it in favor of customers, sending (via e-mail) the booking confirmation with the bank details necessary to make the requested payment. The reservation will be considered confirmed only upon receipt of payment within the established times and a copy of the bank transfer made.
For bookings under date (within 60 days of arrival) you will have to proceed directly with the booking, considered binding and in any case always validated by the copy of the bank transfer made by the deadline date, and confirmed upon receipt of the same.
Booking requests by bank transfer, if not confirmed by the customer by the communicated deadline date and time, will be canceled from the system. The property will therefore be free again and can be booked online.
ONLINE BOOKING PROCEDURE
The structures present on the MARCHE HOLIDAY VILLAS S.R.L. website they can be booked directly online by paying the required deposit via credit card or other online methods. In this case the booking will be effective from the moment the organizer accepts the payment and sends the booking confirmation by e-mail. You will then send the receipt/invoice relating to the same payment.
Upon acceptance of the option: Customers will receive from MARCHE HOLIDAY VILLAS S.R.L. (via e-mail) confirmation of the option containing the expiry date and the bank details to proceed with the payment.
RESERVATIONS MADE LESS THAN 60 DAYS. FROM THE BEGINNING OF THE STAY
For bookings made less than 60 days before the start of the stay, customers will have to pay the entire rental amount in a single payment, at the time of booking. The payment methods to be respected are the same as those adopted in the normal booking procedure.
PAYMENT TERMS VALID FOR RENTAL BOOKINGS WITH A MAXIMUM DURATION OF 4 WEEKS *
The booking form contains the amounts and deadlines of the various payments needed to make the booking, as follows and as will be reported in the individual rental contracts: To be paid at the time of booking: 30% as a DEPOSIT calculated on the rental price from the list in addition to the opening and handling costs and (3.9% of the booking) and the "No-Dep" guarantee (€99.00).
To be paid within 60 days before the start of the rental: 70% as the BALANCE to be paid by bank transfer, credit card or other payment methods.
The booking price includes:
a) Opening and practice management costs;
b) Marche Holiday Villas commissions.
c) NoDep Guarantee
Upon receipt of the deposit payment MARCHE HOLIDAY VILLAS S.R.L. will forward, via email:
– Confirmation of booking;
- Invoice.
Upon receipt of the balance, MARCHE HOLIDAY VILLAS S.R.L. will forward, via e-mail, the documents relating to the booking:
– Voucher;
– Directions to reach the booked property;
- Invoice;
– Link to access the reserved area to be filled in with the names of the participants in the stay.
NB: However, payments for reservations will be regulated and accepted only and exclusively with currency in EURO.

NOTICE OF CANCELLATIONS
This contract pursuant to art. 32 of the Tourism Code does not provide for the right of withdrawal referred to in Legislative Decree 6 September 2005, n. 206 for contracts concluded remotely. However, cancellation of the reservation is permitted which must be received on working days (Monday to Friday from 09.00 to 19.00) before arrival and does not include the day of arrival and the day of the communication itself. The cancellation must be sent via email to req@marcheholiday.it.
CANCELLATIONS VALID FOR RENTAL BOOKINGS WITH A MAXIMUM DURATION OF 4 WEEKS
Cancellation of a reservation, even if replaced by another, involves the payment of the following penalties:
30% of the total booking price (rental price relating to the booked period) plus MHV booking fees in the case of booking cancellation communicated before (and no later than) 60 days from the start of the stay;
60% of the total booking price (rental price relating to the booked period) plus MHV booking fees in the case of booking cancellation communicated between 59 and 30 days from the start of the stay;
80% of the total booking price (rental price relating to the booked period) plus MHV booking fees in the case of booking cancellation communicated between the 29th and 15th day of the start of the stay;
100% of the total booking price (rental price relating to the booked period) plus MHV booking fees in the event of booking cancellation communicated within 14 days before the start of the stay.
The “Booking Fees” (3.9% of the booking) and the “No-Dep” guarantee (€99.00) are never refundable.
PAYMENT CONDITIONS AND TERMS VALID FOR RESERVATIONS OF RENTALS LONGER THAN 4 WEEKS
For rentals longer than 4 weeks, where possible and only on accommodation facilities, the payment and cancellation terms as well as the security deposits will undergo changes which will be communicated at the time of booking with the relevant documentation.
Before the final confirmation of the booking, for stays of this duration, the customer can carry out, upon request, an inspection of the villa of interest. The customer is always required to carefully and carefully read the descriptions, prices and technical information of the property, described on the website https://marcheholiday.it.
CHANGES TO THE BOOKING REQUESTED BY THE CUSTOMER
Changes requested on the booked property after the booking has been confirmed do not oblige the organizer in cases where these cannot be satisfied. The organizer will do everything possible to satisfy the customer but in any case any change or modification, if accepted by the organizer, will incur a fixed charge of Euro 50.00 for the customer. In the event of a request for changes after confirmation of the booking, a penalty will be applied, which may vary based on the seasonality booked and established in agreement with the owners, in the event of: a) moving the booking to the version that has a lower number of beds than the one previously booked (on structures that have two versions or more versions); b) reduction in length of stay (total number of nights); c) the new confirmed booking is in a different season than the one previously booked.
RESPONSIBILITY and COMPLAINTS
All the properties present in the MARCHE HOLIDAY VILLAS S.R.L. catalogue. and on the website www.marcheholiday.it have been selected, examined and photographed by MARCHE HOLIDAY VILLAS S.R.L.. The descriptions published by our company correspond to the actual state of the properties at the time of the visit and acquisition and have been drawn up in good faith.
What MARCHE HOLIDAY VILLAS S.R.L. offers the customer a lifestyle, that is, the opportunity to live and learn about the habits and customs of the local population by spending a holiday in private homes that represent Italian tradition and historical memory and which do not respond to internationally recognized categories, but follow the personal tastes of the owners, so any small deficiencies connected to the characteristics of the architecture and traditions of the place cannot be considered as a reason for complaint. MARCHE HOLIDAY VILLAS S.R.L. is not held responsible in the event that a customer does not find, upon arrival, the property to his or her taste, as the company has provided photos, videos, maps, detailed information and the best possible description of the property, and the customer has signed the booking contract which explicitly requires careful reading of the information relating to the booked property in all its parts. In the event of the presence of disabled people or those with limited mobility, Emma Villas would like to point out that some structures, even if they may have a bedroom and bathroom suitable for disabled people, are still country houses and therefore with all the limitations that this may entail and not necessarily free of architectural barriers even inside. Even in the presence of children, it is advisable to pay attention to the descriptions and photos of the properties and to request further details from the operators of MARCHE HOLIDAY VILLAS S.R.L., in order to ensure that the chosen property is suitable. MARCHE HOLIDAY VILLAS S.R.L. therefore, it is not held responsible in the event that a customer has not correctly read the detailed description of the site, requested a floor plan of the property or contacted the booking operators for further information.
Before final confirmation of the booking, the customer can also carry out, upon request, an inspection of the villa of interest.
The criteria adopted by MARCHE HOLIDAY VILLAS S.R.L. in the choice and selection of structures they are based on the identification of features and accessories capable of guaranteeing a good level of comfort while responding positively to the needs of an international public. If upon arrival or during the week the customer notices serious inaccuracies in the description of the property, or if problems arise that he will not be able to resolve or minimize, he can immediately contact the MARCHE HOLIDAY VILLAS S.R.L. office by calling +39 0721 1836666 (during office hours: Monday to Saturday from 10.00 to 13.00 and from 2.30pm to 6.00pm). The customer must then confirm, in writing, the complaints within 12 hours of arriving at the property or of receiving confirmation of the problem via e-mail (req@marcheholiday.it). MARCHE HOLIDAY VILLAS S.R.L. will work to resolve the problem as soon as possible to ensure a good stay for guests at the booked property. MARCHE HOLIDAY VILLAS S.R.L. however, reserves the right to verify on site and during the holidaymakers' stay, through one of its representatives, the reasons for the complaint and any inaccuracies of the owner, both outside and inside the property. In the event that a customer presents MARCHE HOLIDAY VILLAS S.R.L. a dispute after the end of the stay, without ever having previously contacted the MARCHE HOLIDAY VILLAS S.R.L. Office. during your stay in the booked facility, no form of refund will be recognized. Furthermore, no refund will be due to customers who are removed from the facilities at the request of the owners due to lack of communications relating to excess people or the presence of animals (the number of excess people and the presence of animals must always be communicated in advance to MARCHE HOLIDAY VILLAS S.R.L. and accepted by the latter in agreement with the owners) or in the absence of payment of the security deposit required upon arrival. No form of refund will be due to customers who, in the event of misunderstandings or problems, abandon the property without prior written communication to MARCHE HOLIDAY VILLAS S.R.L., nor to customers who decide to anticipate departure from the booked property, in the absence of valid reasons or serious inconveniences. No form of refund will be available to customers who decide to anticipate their departure without having given an explanation and written justification in advance to MARCHE HOLIDAY VILLAS S.R.L. or who have not carefully consulted the website and found situations that are not suitable for them or without having given the MARCHE HOLIDAY VILLAS S.R.L. representative the opportunity to do so. to verify the motivation of the complaint.
MARCHE HOLIDAY VILLAS S.R.L. does not recognize as justified causes of complaint events not directly attributable to the organizer or the owner of the property: atmospheric events, presence of local fauna, mosquitoes and insects in general (the presence of any non-owned and "passing" animals may occur considering the geographical position of the structures, especially if the location is in isolated and/or countryside areas).
MARCHE HOLIDAY VILLAS S.R.L. does not recognize the lack of electricity, gas or water as justified causes of complaint if this depends on government bodies, external causes or force majeure.
Furthermore, MARCHE HOLIDAY VILLAS S.R.L., unless otherwise communicated in the booking documents, cannot guarantee the drinkability of the water in the properties.
MARCHE HOLIDAY VILLAS S.R.L. declines all responsibility for any inconvenience caused by third parties, such as, for example, maintenance work on public roads or renovations of buildings and the like near the rented properties.
The owners and MARCHE HOLIDAY VILLAS S.R.L. also decline any responsibility for personal and/or valuable objects left unattended inside the property, especially if the necessary precautions have not been taken.
Refunds, if and when due, will be made at the end of the tourist season (no later than December of the current year).
WITHDRAWAL BY THE ORGANIZER
In the event that MARCHE HOLIDAY VILLAS S.R.L. were forced to cancel the customer's booking for reasons beyond their control or due to force majeure, the company will allocate, in agreement with the customer, a new property having the same requirements or the same level as the one previously booked.
In the event that the price of the new property is lower than the booked property, MARCHE HOLIDAY VILLAS S.R.L. will provide a refund in favor of the customer equal to the difference, while if the price of the new property exceeds the amount paid by the customer by 10%, the customer, by accepting the proposed property, will be required to pay the difference of the higher price.
In the event that the customer accepts a replacement of property following his complaint, he will have nothing else to request and/or demand, neither from MARCHE HOLIDAY VILLAS S.R.L., nor from the owner of the structure previously booked and then replaced.
If the parties are unable to reach an agreement on the replacement of the property, upon receipt of the written cancellation of the contract by the customer, MARCHE HOLIDAY VILLAS S.R.L. will refund the amounts paid excluding the registration fee. Under no circumstances will MARCHE HOLIDAY VILLAS S.R.L. will pay hotel bills or alternative accommodations.
USEFUL INFORMATION
Roads and distances the structures of MARCHE HOLIDAY VILLAS S.R.L. they are mostly country villas, located in uncontaminated and peaceful places; Precisely for this reason, the roads leading to the properties are often unpaved, sometimes not very wide, and in some cases quite steep or bumpy.
On each structure presentation page there is a map where you can see the real position of the structure.
MARCHE HOLIDAY VILLAS S.R.L. is not responsible in the event that adverse weather conditions make the roads more difficult to travel or in the event that the customers themselves are not skilled in driving on dirt roads. Furthermore, it is not held responsible in the event that a customer has not carefully consulted the emmavillas.com website in all its parts, as requested and signed in the contract at the time of booking, thus avoiding particular warnings.
EXTRA SERVICES AND COSTS
In the sheets of each property, in the section dedicated to prices, it is clearly shown what the rental price includes or does not include. Ancillary services such as cleaning services or linen changes (where possible, carrying out these services) are on request and can be booked up to 60 days before arrival. After this deadline, confirmation is subject to supplier availability.
Heating cost: The cost can be a flat rate (fixed weekly) or it can be calculated based on consumption, according to the rates in force at the time of the stay. Payment, if it is a lump sum, can be requested at the time of payment of the balance; in the event that heating must be paid according to consumption, the related cost must be paid by the customer directly on site to the owner or to a manager of the structure upon departure.
Use of heating and air conditioning: as regards temperatures and period of use, it is governed by regulations that vary from region to region. In general, heating systems can be used from November to April, for a maximum of 8 hours a day, while air conditioning systems can be used during the summer months. (The regulations regarding the on, off and temperature periods vary from region to region). Customers must mandatorily comply with these rules.
Internet connection: MARCHE HOLIDAY VILLAS S.R.L. and the owners of the structures in which the Internet connection is via USB stick are not responsible for any malfunctions caused by technical problems and/or network problems for which customers are advised to contact the specialized centers in the area directly. For ADSL and WI FI connections, (subscriptions for which are made by the owners independently), in mostly private structures, in the countryside and in areas far from inhabited centres, and for connections with non-broadband signals, some slowdowns or malfunctions could be possible and caused by atmospheric agents, instability of the lines, and/or causes not attributable to MARCHE HOLIDAY VILLAS S.R.L. or the owner. In the event of malfunctions, the owners will do everything possible to remedy the inconvenience but the company intends to point out that some connections may not be suitable for jobs that require the use or download of excessive megabytes, and that the simultaneous connection of multiple devices can cause general slowdowns of the line.
Electric car charging. It is not permitted to recharge electric cars without a specific charging station and without the consent of MARCHE HOLIDAY VILLAS S.R.L. and/or the owner of the booked property; in case of failure to comply with this rule, the customer will be required to pay any extra costs deriving from the use for charging itself and from any structural damage caused to the electrical system and/or the property. If the charging station is present, the cost of the service is to be considered extra to be paid by the customer.
ARRIVAL AND DEPARTURE TIMES
On the days of arrival and departure, the expected arrival times are between 4.00 pm and 7.00 pm, unless otherwise specified in the property information sheet. It is recommended that the customer communicate the arrival time at least one week in advance of the start of the stay so that the owner or his representative can be on site to wait for the customer and facilitate entry to the facility. In the event that the customer needs to arrive late in the evening and after 8.00 pm MARCHE HOLIDAY VILLAS S.R.L. will work to facilitate the arrival of customers at the booked property, trusting in the collaboration of the owners, who may request an extra payment for late check-in. Any changes regarding the date and time of arrival must be communicated as soon as possible to MARCHE HOLIDAY VILLAS S.R.L. via e-mail or by telephone to the numbers provided on the final travel documents (owner and MARCHE HOLIDAY VILLAS S.R.L. Office) to best organize check-in. In the event that the owner is not informed of a possible delay communicated on the day of arrival, and is not able to accept a "late check-in", the customer will have to pay the costs of staying in a structure other than the one booked with MARCHE HOLIDAY VILLAS S.R.L., without having anything to request from the organizer or the owner himself, who will in any case have done everything possible to satisfy the customer. Departure from the property must take place in the morning by 10.00 am, allowing access to the owner to check the state of the property and to the cleaning staff to arrange the house at least one hour before the communicated departure time. In the event that check-out occurs before 08.00, the owners at their discretion may request an extra payment which will be communicated at the time of the request for early check-out. However, the departure time must always be communicated at least 12 hours in advance to the owner or property manager.
ARRIVAL AT THE PROPERTY
Upon arrival at the facility, customers are asked to present the entry voucher and an identification document (passport or identity card) to the owner or his representative for the registration of attendance as required by Italian law, if not previously communicated via the public security form present in the reserved area of each customer. In the absence of these documents, access to the property will take place at the discretion of the owner.
NO-DEP GUARANTEE
SECTION I THE REGULATION:
This document, delivered to the guests, establishes the terms and rules that guarantee and protect them from accidental damage caused to the villas and their contents during the period of stay.
If during the rental period of the property, a guest member of the booking were to cause accidental damage to the building or its contents, MARCHE HOLIDAY VILLAS S.R.L. will guarantee reimbursement of the costs that the owner will have to bear for the replacement or repair of damaged goods, keeping the guest harmless from any requests for compensation.
Accidental damage means damage caused by unforeseen, sudden and, above all, fortuitous events, which do not depend on the direct will of the person involved.
Any damage for which responsibility falls on at least one of the guests making up the booking is considered compensable, even due to gross negligence or gross negligence or incompetence of people or animals for which he is responsible.
Voluntary damages which can in any way be traced back to voluntary acts or vandalism are not subject to compensation. For the latter, the provisions of the Criminal Code of the Italian state referred to in art. 639, part of which is reported below by way of explanation:
Anyone who, outside of the cases provided for in article 635, defaces or defaces the movable property of others is punished, upon complaint by the offended person, with a fine of up to €309.
If the crime is committed on real estate or on public or private means of transport, the penalty is imprisonment from one to six months or a fine from 300 to 1,000 euros.
In the event that MARCHE HOLIDAY VILLAS S.R.L., or the owner, or the Property Manager were to find acts of vandalism caused to the booked property and/or its contents, they have the right to lodge a formal complaint with the competent authorities with the consequent opening of criminal proceedings. In no case will criminal behavior be accepted!
Before leaving the property, during the check out phase, it is necessary to carry out a check on the state of the property and its contents; this check must be carried out by the guest and the owner or Property manager assigned to the villa, in order to ascertain any damage that may have occurred during the stay.
In case of damage, a document called "verification form" will be filled out and must be signed by the guest.
Guests are obliged not to throw away damaged goods, but to keep them so that the owners or Property managers appointed by MARCHE HOLIDAY VILLAS S.R.L. can view them during check out.
Any theft of goods from the villas will be considered theft and, as such, will be regulated by the art. 624 of the Italian Penal Code.
We recommend promptly informing the owners and Property Managers of any damage caused to the property and/or its contents during the stay.

SECTION III: OBLIGATIONS ON THE PART OF THE GUEST IN THE EVENT OF AN ACCIDENT
In the event of damage to the property or its contents, the guest has the obligation to immediately notify the owner or the Property Manager or MARCHE HOLIDAY VILLAS S.R.L. and in any case by check out.
Before leaving the property the guest must complete and sign the "Check Form" indicating the damaged goods, specifying the dynamics of how the damage occurred.
NUMBER OF GUESTS AND THEIR IDENTIFICATION
At the time of booking or close to check-in, customers will be required to enter the names and ages of the people who will be staying in the property, in order to communicate their presence to the competent authorities. In the profile of each property, both on the web and in the catalogue, a maximum number of people that the structure is able to accommodate is indicated. This number (adults - children - infants) cannot be exceeded in any way. In the event of alterations in the number of people present or in the arrangement of the rooms upon arrival, the owner who has not been previously informed by the Agency and who has not accepted any changes will not be required to respect them. If it is within his power to satisfy customers, they will still have the obligation to pay the requested supplements.
Events in the villa: Only some properties are suitable for hosting events therefore MARCHE HOLIDAY VILLAS S.R.L., for any particular request, before making any reservation, always recommends contacting the Booking Office by telephone on +39 0721 1836666 or by writing to req@marcheholiday.it. The realization of any type of event is subject to MARCHE HOLIDAY VILLAS S.R.L. approval, therefore it must be expressly requested by the customer sufficiently in advance and formally approved by the company; in case of approval, extra costs will be applied to the customer based on the number of people present at the event (and based on any other particular request or need). Without formal authorization from the company and the owner of the structure it is not permitted to hold events in the villa (birthday parties, anniversaries, weddings, private parties, etc.) and it is therefore not permitted to organize catering, music and other banqueting services that require external staff.
CHILDREN 0-24 months
MARCHE HOLIDAY VILLAS S.R.L. will be happy to provide cots, cots and high chairs for children upon request. In most facilities it is a service that is offered free of charge for the first cot, further cots requested will cost €60.00 each per week. The company please communicate the number of cots requested via email to req@marcheholiday.it, and in any case at least 45 days before your arrival.
ANIMALS
The sheets for each property indicate whether pets are allowed, what size and customers will be asked for a cleaning fee to be paid on site to the owner. At the time of booking, the customer is required to communicate any pets they will bring with them, indicating their number and size via email to req@marcheholiday.it. The owner may prohibit entry to a customer who brings an animal without having communicated it at the time of booking, or not accept animals when the number of them seems excessive for his property. An additional payment for cleaning in the event of the presence of animals may be requested on site if the property is excessively dirty. It is not permitted to let pets swim in the pool or climb onto beds and sofas.
CLEANING OF THE PROPERTY;
Initial and final cleaning of the property is included in the rental price, unless otherwise indicated in the property sheet published on the web and in the catalogue. Weekly cleaning (applicable only to accommodation facilities) does not include kitchen cleaning and waste disposal.
The properties must be returned in good hygienic conditions in all their parts and accessories. Otherwise the customer will have to pay the owner or his representative the cost necessary for cleaning. It is the customer's responsibility to take care of waste disposal unless otherwise indicated.
If guests do not dispose of waste from the property, the owner or his delegate may request a supplement for this service. The kitchen must be left in good hygienic conditions and as tidy as possible. If, for any reason, including time, guests are unable to clean the kitchen and furnishings before their departure, the owner will have the right to request a supplement for cleaning the same.
MAINTENANCE OF THE POOL AND PARK
The swimming pools will be open during the periods indicated in the information for each property (openings in the low season will also be regulated by weather conditions). Any openings outside the indicated period must be agreed with the owner and will require the payment of a supplement.
The gardeners and property managers in general constantly work hard to keep the park in excellent condition (with green and regularly watered lawns, cut grass, well-kept flowers, etc.). However, it should be noted that the state of the properties' lawns may not comply with the photos published on the site in the event of periods of severe and prolonged drought and/or in the event that there are municipal/governmental ordinances that rationalize or prevent the consumption of water for irrigation purposes. In this case MARCHE HOLIDAY VILLAS S.R.L. cannot be held responsible for any worsening state of the gardens.
EXCEPTIONAL MAINTENANCE AND INTERVENTIONS
In case of maintenance or exceptional interventions essential for the smooth running of the holiday, customers will under no circumstances be able to prohibit the access of the owners or those responsible for the structures inside the property or home. It is understood that the owners will always provide advance notice and require the presence of the guests themselves, it being understood that where the guests cannot be present during the carrying out of the works, the owners or their representatives will still be able to enter the homes, if necessary, to carry out any repair work.
TOURIST TAX
Based on the provisions set out in the art. 4 of Legislative Decree no. 23 of 14 March 2011) Italian municipalities with a predominantly tourist vocation can request the tourist tax, intended to finance tourism-related interventions including those to support accommodation facilities, the maintenance, use and recovery of cultural and environmental assets, as well as local public services. The tax is applied to each overnight stay (i.e. for each person and for each night), and the amounts (generally between €0.50 and €5.00 per person per night) are established by the Municipality to which the booked property belongs; Possible exemptions may be foreseen (such as for children under 14, disabled people, etc.). The tax, if required by the municipality of the property, must be paid on site.
RULES OF BEHAVIOR
Guests are kindly asked to observe the behavioral rules in force in our country, regarding good manners and to show the utmost respect towards the owner and the structure in which they are staying. It is therefore absolutely forbidden to move furniture inside the home, take internal furniture and furnishings outside the home and/or make any use other than that for which they are intended. In the event that a guest does not respect the rules of good behavior and these are the basis of damage caused to the structure or to the furnishings contained therein or to the supplies external to the house in relation to the garden and swimming pool, the owner will have the right, at his sole discretion, to consider the rental contract terminated by means of verbal communication to the guest and in written form, for information to the agency, and request the immediate removal of the customer from the property with the right to also resort to the police.
MARCHE HOLIDAY VILLAS S.R.L. declines any responsibility in the event of disputes between the customer and the owner. In the event of legal action, the owner will provide the customer with the data of the competent court.
CIVIL AND GENERAL LIABILITY
In accordance with Italian law and that of the European Community regarding guarantees for customers in the tourism sector and with regional law n. 16 of 02/08/1994, MARCHE HOLIDAY VILLAS S.R.L. has taken out the following insurance:
Civil and general liability: EUROP ASSISTANCE Policy n. 2398145
This insurance covers the civil liability of MARCHE HOLIDAY VILLAS S.R.L. – Via Luigi Einaudi, 24 I – 61032 – Fano (Pu), Italy – in his role as organizer and intermediary of trips and stays. This insurance was stipulated in accordance with the C.C.V. (International Convention on Travel Contracts) and to EEC directive 90/314 assimilated by law L.R. 11/07/2006, n. 9, "Consolidated text of regional regulations on tourism", published in the B.U. Marche 20 July 2006, n. 73
GUARANTEE FUND
The National Guarantee Fund (art. 100 of the Cons. Code) established to protect consumers who are in possession of a contract, provides for the following needs in the event of insolvency or declared bankruptcy of the seller or organizer:
- refund of the price paid;
- repatriation in the case of travel abroad.
The fund must also provide immediate financial availability in the event of the forced return of tourists from non-EU countries in the event of emergencies attributable or not to the organiser's behaviour.
The Fund's intervention methods are established by the decree of the President of the Council of Ministers of 07/23/99, n. 349, Official Gazette n. 249 of 12/10/1999.
PERSONAL DATA PROCESSING
The personal data and any other element learned by our Agency during the performance of the assignment will be subject to secrecy and will be processed in compliance with confidentiality and the rights of the person through the systematic application of specific protection and guarantee measures prepared for both paper and electronic data processing and measured according to the specificity of the data itself (simple personal data or sensitive or judicial data). Pursuant to and for the purposes of Legislative Decree 196/03, the Customer is informed that his personal data will be processed only for the purposes determined by the contractual relationship for such purposes (including accounting and administrative purposes). These data could be used for commercial and promotional activities relating to the services provided by MARCHE HOLIDAY VILLAS S.R.L., for the latter use consent to processing is required. The lack of consent from the Customer will not allow the Company to use personal data to carry out commercial activities.
All documents MARCHE HOLIDAY VILLAS S.R.L. are written in Italian and English (used as the official international language), the conditions are regulated and applied according to the rules of Italian law.
